Welcome to ChatTok Gaming ("ChatTok Gaming," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, games, tools, and related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

Eligibility and Accounts

1.1 Minimum Age
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Services.

1.2 Account Responsibility
You are responsible for:
(a) maintaining the confidentiality of your login credentials; and
(b) all activity that occurs under your account.

If you believe your account has been compromised, you must notify us promptly.

Subscription Plans and Billing

2.1 Subscription System
ChatTok Gaming currently offers daily, weekly, and monthly subscription plans, and may introduce additional plan options or durations in the future.

2.2 Payment Authorization
By subscribing, you authorize us and our payment processors (such as Stripe) to charge you the subscription fees associated with your selected plan, plus any applicable taxes.

2.3 Auto-Renewal
Unless otherwise stated, subscriptions automatically renew at the end of each billing period at the then-current rate. You can cancel auto-renewal at any time in your account settings or through your payment provider before the next billing period begins.

2.4 Plan and Price Changes
We may modify our subscription offerings and pricing from time to time. Any changes will apply to future billing periods and, where required by law, we will notify you in advance. Your continued use of the Services after the effective date of any change constitutes your acceptance of the new pricing and/or plan structure.

2.5 Refunds
Except where required by applicable law, all subscription fees are non-refundable. This includes situations where:
(a) you cancel before the end of your current billing period; or
(b) you do not fully use the Services during a billing period.

Game Access and Virtual Features

3.1 Access Through Subscription
Your active subscription provides access to certain games, experiences, and related features ("Game Access Features") as described on our website or within the Services.

3.2 Virtual Features; No Cash Value
Some games or experiences may include in-game or platform-based features (for example, virtual items, enhancements, boosts, or similar digital elements). Unless we expressly state otherwise in writing:
(a) these features are licensed, not sold;
(b) they have no real-world cash value; and
(c) they are non-transferable and non-redeemable for money or other value outside of the Services.

3.3 Changes to Games and Features
We may add, modify, or remove games, modes, and virtual features at any time, including experiments or promotional features, without liability to you, provided that doing so does not materially breach any specific obligations we have under applicable law.

Earnings and Performance Disclaimer

4.1 No Guarantee of Earnings
ChatTok Gaming does not guarantee that you will earn any money, diamonds, gifts, followers, or other benefits by using our Services, hosting live streams, or playing any games.

4.2 Illustrative Examples Only
Any examples of potential earnings, engagement, or performance (including screenshots, testimonials, or sample results) that we share are illustrative only. They are based on specific circumstances and must not be interpreted as typical, promised, or guaranteed outcomes.

4.3 Individual Results Vary
Your results depend on many factors beyond our control, including but not limited to:
(a) your content, performance, and personality;
(b) audience size and engagement;
(c) platform algorithms and policies (such as TikTok); and
(d) your time, effort, and strategy.

You acknowledge that you may earn nothing at all, and you accept this risk by using the Services.

Use of the Services

5.1 Lawful Use Only
You agree to use the Services only:
(a) for lawful purposes; and
(b) in accordance with these Terms and all applicable laws and regulations.

5.2 Prohibited Conduct
You agree that you will not:
(a) engage in any illegal, harmful, fraudulent, or deceptive activity;
(b) upload or transmit any viruses, malware, or harmful code;
(c) interfere with, disrupt, or damage the operation or security of the Services;
(d) harass, threaten, abuse, or harm other users; or
(e) attempt to gain unauthorized access to any accounts, systems, or networks connected to the Services.

We may investigate and, where appropriate, refer suspected illegal activity to law enforcement.

Content and Intellectual Property

6.1 Our Content
All content and materials on or within the Services, including but not limited to text, graphics, logos, game designs, software, and the overall look and feel, are owned by ChatTok Gaming or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.

6.2 Your Content (General User Content)
If you submit, upload, or display any content in connection with the Services (for example, usernames, avatars, profile images, messages, or chat interactions) other than games created with the Game Builder described in Section 7, you grant ChatTok Gaming a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, display, distribute, and create derivative works from such content as reasonably necessary to operate, improve, and promote the Services.

You represent and warrant that you have all rights necessary to submit such content and to grant the license described in this Section.

Game Builder and Submitted Games

7.1 Definition of Game Builder
For purposes of these Terms, "Game Builder" means any game creation tools, templates, scripts, editors, or graphical interfaces that ChatTok Gaming makes available to you to create or configure games for use on or with the Services.

7.2 Ownership of Game Builder Tools
All rights, title, and interest in and to the Game Builder (including its underlying code, templates, assets, and documentation) are and will remain the exclusive property of ChatTok Gaming and its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Game Builder solely to create games for use on the ChatTok Gaming platform, subject to these Terms.

7.3 Assignment of Rights in Games Created With the Game Builder
If you use the Game Builder to create a game and submit that game to ChatTok Gaming for launch or distribution on our platform ("Submitted Game"), then, as between you and ChatTok Gaming, you hereby irrevocably assign and transfer to ChatTok Gaming all right, title, and interest in and to the Submitted Game, including all associated copyrights and other intellectual property rights, subject only to any third-party materials you do not own.

Upon submission, ChatTok Gaming will be the sole and exclusive owner of the Submitted Game and may use, reproduce, modify, adapt, translate, publicly perform, publicly display, distribute, monetize, license, and otherwise exploit the Submitted Game in any manner and in any medium now known or later developed, without further permission, notice, or compensation to you.

7.4 Third-Party Assets
This assignment does not transfer ownership of any third-party assets, libraries, or materials that you do not own and that you lawfully incorporate into a Submitted Game. However, you represent and warrant that you have all rights and permissions necessary to:
(a) include those materials in the Submitted Game; and
(b) allow ChatTok Gaming to use and exploit the Submitted Game as described in this Section.

7.5 Limited Personal Use License (Optional)
ChatTok Gaming may, in its sole discretion, grant you a limited, non-exclusive, non-transferable license to use the Submitted Game for your personal, non-commercial purposes outside of the ChatTok Gaming platform, provided that such use does not conflict with or compete with ChatTok Gaming's use, distribution, or commercialization of the Submitted Game. Any such permission may be granted, limited, or revoked by ChatTok Gaming at any time.

Third-Party Platforms and Services

8.1 TikTok and Other Platforms
The Services may integrate with or rely on third-party platforms such as TikTok. Those platforms are governed by their own terms and policies, which you must comply with in addition to these Terms.

8.2 No Affiliation
ChatTok Gaming is not owned by, affiliated with, or endorsed by TikTok or any other third-party platform, even if our Services are used alongside or in connection with those platforms.

8.3 Third-Party Links
The Services may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of such third parties and we do not endorse them. Your use of any third-party websites or services is at your own risk.

Termination and Suspension

9.1 Our Right to Terminate or Suspend
We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe that you:
(a) have violated these Terms or applicable law;
(b) pose a risk to other users or to the security or integrity of the Services; or
(c) misuse or abuse the Services.

9.2 Effect of Termination
Upon termination of your access to the Services:
(a) your right to use the Services immediately ceases; and
(b) you may lose access to any associated data or virtual features.

Except where required by law, subscription fees are not refunded upon termination or suspension.

You may stop using the Services at any time and may cancel your subscription by following the instructions on our site or through your payment provider.

Disclaimers

10.1 "As Is" Basis
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 No Guarantee of Availability
We do not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

10.3 Platform Changes
We are not responsible for any changes made by third-party platforms (such as TikTok) that may affect how the Services function or your ability to use them.

Limitation of Liability

To the maximum extent permitted by law, ChatTok Gaming and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or in connection with your use of, or inability to use, the Services.

Our total aggregate liability for all claims related to the Services will not exceed the amount you have paid to us in subscription fees during the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless ChatTok Gaming and its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
(a) your use of the Services;
(b) your violation of these Terms; or
(c) your violation of any rights of another person or entity.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. If changes are material, we may provide additional notice as required by law.

Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services.
